What are the Requirements for an H-2A Visa?
The H-2A temporary agricultural program establishes a means for agricultural employers who anticipate a shortage of domestic workers to bring nonimmigrant foreign workers to the U.S. to perform agricultural labor or services of a temporary or seasonal nature.
There are 2 parts to the H-2A visa application process:
The employer must demonstrate that he/she has been unsuccessful in finding capable U.S. workers to perform the temporary agriculture service. This is demonstrated by obtaining a Temporary Labor Certification (application ETA 750A) from the U.S. Department of Labor. This is the first step in the H-2A application process. Once this has been received, the employer will use the approved labor certification to apply for an H-2A visa, on behalf of the agricultural worker, with the USCIS.

How Long is the H-2A Visa Valid?
The H-2A visa will be issued for no longer than one year.
