This application may also be used to apply for protection under the Convention Against Torture. A refugee is a person who is unable or unwilling to return to his or her country of nationality, or last habitual residence in the case of a person having no nationality, because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion. <br><br></span> <span class="subhead">What about my spouse and children?<br></span> <span class="text">You may include in your application your spouse and your unmarried children who are under 21 years of age and physically present in the United States. Married children and children 21 years of age or older must file a separate Form I-589 application. If you are granted asylum, you may file a petition Form I-730, Refugee and Asylee Relative Petition, OMB No. 1115-0121, for your spouse and/or any unmarried children under the age of 21 whom you did not include in your application. <br><br></span> <span class="subhead">What Additional Documents will be needed with this application??<br></span> <span class="text">If they are available to you, you should submit documents evidencing (1) the general conditions in the country from which you are seeking asylum, and (2) the specific facts on which you are relying to support your claim.
