Applications for K-3 visas are not accepted for processing at the U.S. Consular Office or Embassy outside of the U.S.<BR><BR> A K-3 visa application must meet three requirements: <ol> <li>The foreign national must already be married to a U.S. citizen who has filed a relative petition (I-130) on his/her behalf with the USCIS for the purposes of an immigrant visa;</li> <li>That same U.S. citizen spouse must be petitioning on behalf of that same foreign national to obtain a nonimmigrant visa; and,</li> <li>The foreign national must be seeking to enter the United States to wait the "availability of an immigrant visa"</li> </ol> <br> A dependent child of a K-3 visa holder is considered a K-4 nonimmigrant when accompanying the K-3 visa holder into the U.S. There is no need to file a separate petition in the U.S. for the dependant child (under 21) of a K-3 visa holder. Once the K-3 is approved the beneficiary will obtain that visa and all dependant K-4 visas for his/her children at the U.S. Consulate.<BR><BR> <br><br></span> <a name="valid" id="valid"></a> <span class="subhead">How Long Is The K-3 Visa Valid?<br></span> <span class="text">The K-3 status terminates 30 days after a denial of the relative petition or application for immigration status based on such a petition.
