What is E-Verify?
The law requires businesses that employ foreign workers in the United States to verify that their employees have the necessary authorization to work in the U.S. Employees may have a variety of visas to be eligible to work in the U.S. including, H-1B & H-1C, H-2A & H-2B, O, P, and L visas. E-Verify is a web-based employment verification system that checks the validity of I-9 Form information, operated by the Department of Homeland Security (DHS) and the Social Security Administration (SSA). The system compares information provided on an employee’s I-9 form against information in government records.
What if my employee does not pass verification?
If the information on an employee’s I-9 form does not match that in government databases, both employee and employer will be notified immediately. The employee is allowed to work while he or she resolves the discrepancy within 8 days. If the employee wants to correct the error, the employer must forward the case to the appropriate office and provide a referral letter explaining what the employee can do to resolve the problem. It is then in the employee's hands to identify the correct information to DHS, SSA, or the employer for resubmittal.
Should you use E-Verify?
E-Verify use is governed by state law and not by federal law. Some states which require E-Verification include Arizona, Mississippi, South Carolina, and Utah. Nationwide, E-Verify is mandated only for federal contractors and subcontractors. It is optional for most other employers (contingent upon state legislation). Voluntary use of E-Verify can have implications you should carefully assess before making a decision.
