A marriage green card is an immigrant visa which grants legal resident status to the spouse of a US citizen or US green card holder.

The Marriage Green Card Process

The marriage green card process will depend on where the foreign national spouse is located, inside or outside of the United States.  If the foreign national spouse is currently located outside of the United States and the couple is not yet married and prefers to apply for the marriage green card while inside the United States, then VISANOW recommends to apply for a  K-1 Fiancé visa.  If the couple is already married and the foreign national spouse is already inside the United States, then the correct marriage green card process to follow would be Adjustment of Status.  If the couple is already married but the foreign national spouse is located outside of the U.S., then the correct marriage green card process to follow is Consular Processing.

Apply for a Marriage Green Card while inside the United States: Adjustment of Status

The amount of time that the marriage green card process takes will depend on the sponsor/petitioner’s status in the United States.  Priority is always given to spouses of U.S. citizens. Currently, the wait time for a U.S. citizens’ spouses’ green card is about 5-8 months.

Apply for a Marriage Green Card while outside the United States: Consular Processing

If the foreign national spouse is located outside of the United States, then obtaining a green card by marriage will include two steps.

1. I-130 application
   The purpose of the I-130 application is to prove to USCIS that the sponsor and the foreign national spouse are legitimately married.  This can be difficult since most couples do not know how to document the legitimacy of their relationship.  It is critical that all forms are prepared accurately and that a strong case is established in order to ensure the spouse’s green card is approved.
2. Consular Processing:
   Once the I-130 application is approved, the petition is forwarded to the National Visa Center for further processing.  This step can be very confusing and time consuming. To ensure that the marriage green card process moves as quickly as possible and to minimize the risk of being denied, it is critical that all documents are accurately collected according to local consulate requirements, all government fees are paid in full, and the medical exam is completed.  The marriage green card interview will then be scheduled at the local U.S. consulate.  VISANOW is here to ensure that you move as quickly as possible through this process while being effectively prepared for the final interview.
