The I-130, Petition for Alien Relative, and the I-485, Application to Register Permanent Residence or Adjust Status, may be filed concurrently if the applicant is an immediate relative (i.e. spouse, child, or parent of a U.S. citizen) and if the applicant is presently in the U.S.

If the I-485 applicant is not an immediate relative, the I-485 can only be filed when the applicant’s priority date becomes current as determined by the Department of State’s monthly Visa Bulletin.
