Work

In 2008 and 2009 the UK introduced a points based system. In order to qualify for work authorization, you will have to determine your eligibility in the eyes of the UK Border Agency by passing a points-based assessment.

Tier 1

Highly Skilled Workers -

With the Highly Skilled Worker permit you do not need to have a job offer or a sponsor. You are awarded points based on qualifications, previous earnings, UK experience, age, English language skills and available money.

Entrepreneurs-

This category is for those who are investing in the UK by setting up or taking over one or more businesses in the UK.

Investors -

Individuals with a high net worth who will make a substantial financial investment in the United Kingdom can apply for a Investors Tier 1 permit. You must be able to invest £1,000,000 in the United Kingdom

Post-study workers -

This category is for recent international graduates who have been studying in the UK. It gives them an opportunity to look for employment. The intent is they will switch to another tier as soon as they are able to.

Tier 2

General -

Tier 2 is for individuals going to the UK with a skilled job offer. The Position they are fulfilling must fill a gap in the workforce that cannot be filled by someone already settled in the UK. Before applying for a Tier 2 permit, you must have a sponsor and valid certificate of sponsorship.

Intra Company Transfer -

This category is for employees of multi-national companies who are being transferred by an overseas employer to a skill position in the UK based branch. Before applying for a Tier 2 permit, you must have a sponsor and valid certificate of sponsorship.

Sponsor -

All UK employers seeking to employ foreign nationals are required to hold a sponsorship licence issued by the UK Border Agency (UKBA). Once licensed, a sponsor will be entitled to issue Certificates of Sponsorship (CoS) to prospective migrant workers in support of their applications to enter or remain in the UK for the purpose of work.

Post-study workers -

This category is for recent international graduates who have been studying in the UK. It gives them an opportunity to look for employment. The intent is they will switch to another tier as soon as they are able to.

Three main concepts when the UKBA is evaluating if a company can be approved as a sponsor:
  • Is the applicant a bona fide organisation operating lawfully in the UK?
    • In order to prove this, the prospective sponsor will need to provide certain documents.
  • Is the applicant trustworthy?
    • In order to ascertain this, the Agency will look at the history and background of the organisation.
  • Is the applicant capable of carrying out its duties as a sponsor?
    • The UKBA will judge this by looking at the organisation’s processes and Human Resources practices to ensure they have the ability to comply with the obligations of being a sponsor.
