ETA 750 A&B. The ETA 750 A & B application for alien labor certification is filed with the state employment office, and is forwarded to the Regional U.S. Department of Labor Office.
I-140. On issuance of the labor certification, the I-140 immigrant visa preference application is filed with USCIS.
I-485. Next, if the applicant is in the U.S. and in lawful status, the I-485 application for U.S. Lawful Permanent Residence ("Green Card") is filed with USCIS. This is also called 2nd and 3rd Preference Employment-Based Immigration.

What Is The Benefit Of the PERM Process?
The PERM Process (Program Electronic Review Management System) governs the processing of labor certification applications for the permanent employment of foreign workers in the US. This new regulation will apply to all applications filed on or after March 28, 2005. Applications filed before this rule’s effective date will continue to be processed and governed by the current regulation, except to the extent an employer seeks to withdraw an existing application and re-file it in accordance with the PERM rules. VisaNow anticipates an electronically filed application not selected for audit will have a computer generated decision within 45 to 60 days of the date the application was initially filed.
When should I conduct my Recruitment?
The mandatory recruitment steps must be conducted at least 30 days, but no more than 180 days, before the filing of the application. The employer must maintain documentation of the recruitment and be prepared to submit this documentation in the event of an audit or in response to a request form the Certifying Officer prior to rendering a final determination.
What types of recruitment are needed?
The regulations specify that two Sunday newspaper advertisements will be required. The advertisements must be placed on two different Sundays in a newspaper of general circulation in the area of intended employment. Documentation of the advertisements can be satisfied by furnishing copies of the newspaper pages in which the advertisements appeared or proof of publication furnished by the newspaper. If the job involved in the application requires experience and an advanced degree, and a professional journal normally would be used to advertise the job opportunity, the employer may, in lieu of one of the Sunday advertisements, place an advertisement in the professional journal most likely to bring responses from qualified US Workers.
The employer must select three additional recruitment steps from the alternatives listed below. Only one of the steps may consist solely of activity that took place within 30 days of the filing of the application. None of the steps may have taken place more than 180 days prior to filing the application.
