What Are The Requirements for an H-3 Visa?
The H-3 visa applicant must be invited to the U.S. by an individual, organization, firm, or some other institution to receive training in a particular field, such as agriculture, commerce, communication, finance, government, transportation, or the professions. Physicians coming to the United States for graduate medical education or training are not entitled to an H-3 visa.
The training program must meet five requirements:
The training is not available in the H-3 visa applicants own country;
The training does not put the H-3 visa applicant in a position that functions in the normal operation of business;
U.S. citizen and resident workers are generally not employed in the training position;
The H-3 visa applicant will not engage in productive employment unless such employment is incidental and necessary to the training; and
The training will benefit the applicant in pursuing a career outside the United States.
How Long Is The H-3 Visa Valid?
An H-3 visa holder is admitted to the U.S. for the period that is required to complete the training, which is limited to two years.
