Who Qualifies For A V-2 Visa Classification?
Children of U.S. Lawful Permanent Residents (Green Card) who are the beneficiary of an immigrant visa petition that has been pending with the Immigration and Naturalization Service for at least 3 years or that has been approved and 3 years has passed since the filing date.
What Are The Requirements For A V-2 Visa?
The child must be unmarried, under 21 years old and the beneficiary listed in Form I-130 that has been:
Pending for 3 years or more; or,
Approved and 3 years have passed since the date of filing;
And, at the present time:
An immigrant visa number is not yet available to the beneficiary; or,
An immigrant visa number is available to the beneficiary, but his/her application for an immigrant abroad or application for adjustment of status in the U.S. is still pending.
Can V-2 Beneficiaries Be Employed?
Yes, employment is allowed under this visa classification and can be approved after the concurrent or subsequent filing of an I-765.
How Long Is The V-2 Visa Valid?
A V-2 visa is valid and beneficiaries are authorized to remain in the U.S. until their authorized stay expires (at which time an extension may be requested) or until one of the following is denied:
Form I-130, Petition for Alien Relative, filed by the LPR on behalf of his/her child;
Application for an immigrant visa abroad; or,
Form I-485, Application for Adjustment of Status.
